BREACH OF THE DROVING ACT

The first case under the Droving Act in this district was beard at Bangemall on August 12, before Mr. C. XL Dunlop J.P. This was an action taken by the police against E Wheelock drover, for travelling with a mob of sheep, the property,of Messrs Tullock and Co. without a proper waybill.
In giving his decision the Magistrate said it was not his intention to inflict heavy fines, especially as it was the first case that had come under the operation of the Act in the district.
Ignorance of the law, however, was no excuse, nor did the defendant advance this, having admitted that he knew that the waybill was informal, but that he was not »ware that he was liable for accepting and travelling on it.
It men who are engaged in droving did not make themselves conversant with the Droving Act, and refused to accept waybills from owners unless they were properly drawn, and the stock described in a proper manner, they had only themselves to blame for getting into trouble.
Description was the most important cart in a waybill. If there were twenty different brands, it was imperative that they be all enumerated in the schedule. Describing a travelling mob of sheep or cattle as "mixed" and "brands and ear-marks various" was a very loose and reprehensible practice; and not at all in accordance with the Act.
Owners were usually the first to take, action against persons travelling in charge of stock whose "waybills were informal when they were themselves guilty of contributory negligence following their stock to leave their runs without providing their drovers with a waybill in accordance with the Act.
In future police should confine their operations alone to the drovers who were not the owners but to the owners as. well. As the drover was liable for travelling with sheep or cattle which were not properly described, by the the owner, whose duty it was to provide him wife a travelling statement and delivery note which must be drawn, declared, and signed by him the owner or his authorised agent in the presence of a witness.
